BLB&G associate Caitlin Bozman addresses the misconceptions surrounding ESG (environmental, social, and governance) in a new article published by the American Bar Association.
Bozman explains that despite recent political contention, ESG principles have been deeply rooted in corporate responsibility, predating the term itself. The anti-ESG movement's claim that ESG undermines corporate value directly contradicts Delaware law, which emphasizes long-term value creation. She asserts that ESG aligns with fiduciary duties by improving long-term financial performance and providing downside protection, citing numerous supporting studies and legal precedents.
